  1. Scope and Object of the General Store Conditions

These General Terms and Conditions are intended, together with the order form and the other elements referred to therein, to regulate the terms and conditions which will govern the provision of the Azores Playground Online Shop Service. The Service consists of the provision, through the address www.azoresplayground.com of access to the Online Store which, in addition to supplying information relative to a set of products and/or services, allows the User, electronically, to order the products divulged therein, under the terms and conditions described herein. The order of products must be made by Users with age equal to or greater than 18 (eighteen) years (individuals under this age must have the authorization of their representatives). The elements and information transmitted by the User shall enjoy full legal effect, recognizing the User’s electronic purchases, and the User may not allege the lack of signature for failure to comply with the obligations assumed.

 

2. Product Information and Contents

Azores Playground will do everything possible so that the information presented does not contain typographic errors, which will be quickly corrected whenever they occur. If you purchase a product with different characteristics to those presented online, you have the right to proceed to the resolution of the purchase contract under the legal terms applicable (right of free resolution – see point 9).Azores Playground will do everything possible to send all the products ordered, but it is possible that, in certain cases and due to causes hardly controllable by Azores Playground, such as human errors or incidents in computer systems, it is not possible to provide some of the products requested by the User. If any product is not available after you have placed your order, you will be advised by email or phone. At that moment you will be presented with the possibility of cancelling the order with the respective reimbursement, if you have already made the respective payment. All information about price, products, specifications, promotional actions and services may be changed at any time by Azores Playground.

 

3. Responsibilities

3.1 All products and services commercialized in Azores Playground Online Store are in accordance with Portuguese Law.

3.2 The Store has the appropriate levels of security, however Azores Playground will not be liable for any damages suffered by the User and/or third parties, due to delays, interruptions, errors and suspensions of communications originating from factors beyond its control, in particular, any deficiencies or failures caused by the communications network or communications services provided by third parties, the computer system, the modems, the connection software or any computer viruses or arising from the download (“download”) through the service of files infected or containing viruses or other properties that may affect the User’s equipment. If for any reason of access error to the website of the Azores Playground Online Store, it is impossible to provide the service, Azores Playground will not be liable for any losses.

3.3 The data and information consultations made in the scope of this service are assumed to have been made by the user, Azores Playground declining any liability resulting from abusive or fraudulent use of the information obtained.

3.4 Azores Playground will not be liable for any losses or damages caused by abusive uses of the Service which are not directly attributable to the User by way of intent or serious fault.

3.5 Azores Playground is not responsible for the losses or damages resulting from the non-performance or defective performance of the Service when such is not directly or indirectly attributable to Azores Playground by way of intent or serious fault and is not responsible for (i) errors, omissions or other inaccuracies concerning the information made available through the Service; (ii) damages caused by the fault of the User or third parties, including violations of intellectual property, (iii) the non-compliance or defective performance resulting from compliance with court orders or administrative authorities or (iv) the non-compliance or defective performance resulting from the occurrence of situations of force majeure, i.e. situations of an extraordinary or unforeseeable nature, outside Azores Playground and which cannot be controlled by it, such as fires, power cuts, explosions, wars, riots, civil insurrections, government decisions, strikes, earthquakes, floods or other natural cataclysms or other situations not controllable by Azores Playground which prevent or impair the performance of the obligations undertaken.

 

3.6. Azores Playground does not guarantee that:

(i) the Service will be provided uninterruptedly, will be secure, error-free or will operate infinitely;

  1. ii) the quality of any product, service, information or any other material purchased or obtained through the Service fulfils any expectations of the User in relation to it;

3.7. The User agrees that Azores Playground cannot in any way be held liable for any damages, including, but not limited to, damages for loss of profits, data, content, or any other losses (even if it has been previously advised by the User of the possibility of such damages), resulting from:
– the use or inability to use the Service;
– the difficulty in obtaining any substitute goods/services;
– from unauthorized access or modification to personal databases.

4. Obligations of the Consumer
4.1. The user undertakes to:
(i) Provide correct personal data and addresses;
ii) Not to use false identities;
iii) Respect the order limits imposed.
4.2 If any of the data is incorrect or insufficient, and for this reason there is a delay or impossibility in processing the order, or eventual non-delivery, the responsibility is of the user, and Azores Playground declines any responsibility. In case the consumer violates any of these obligations, Azores Playground reserves the right to eliminate future purchases, block access to the store, cancel the supply of any other services made available simultaneously by [NAME] to the same User; and also not allow future access of the User to any service or services made available by Azores Playground.
4.3 It is expressly forbidden to use the products and services purchased for commercial purposes, namely for the purpose of resale of goods.

 

5.Privacy and Protection of Personal Data

5.1. Azores Playground guarantees the confidentiality of all data provided by Users.

5.2 The personal data identified in the order form as being mandatory are essential for the provision of the Service by Azores Playground. The omission or inaccuracy of the data provided by the User are of its sole and entire responsibility and may lead to the refusal of the provision of the Service by Azores Playground.

5 .3. The User’s personal data will be processed and stored on computer and are intended to be used by Azores Playground in the context of the contractual and/or commercial relationship with the User and, if authorised by the User, for the marketing of INDICATORS IN CASE BY CASE AND IN ACCORDANCE WITH THE PURPOSE OF THE COMPANY IN CONCRETE

5.4. In the terms of the applicable legislation, the User is guaranteed, at no additional cost, the right to access, rectify and update their personal data, directly or by written request, as well as the right to object to the use of the same for the purposes set out in the previous paragraph, and to this end should contact the entity responsible for the processing of personal data: Azores Playground.

5.5. The Internet is an open network, therefore, the User’s personal data, other personal information and all the content hosted in the Service may circulate on the network without security conditions, with the risk of being accessed and used by third parties not authorised for this purpose, and Azores Playground cannot be held responsible for this access and/or use.

 

6. Cancellation of orders

6.1 At the request of the User, the User may cancel his order by requesting it to Azores Playground through the phone number or email referring the order number, which will be accepted as long as it has not been processed yet. After its processing, Azores Playground will try to make the delivery of the same, but the User has the option not to accept it. For the cancellation effect, the User must indicate the following data to Azores Playground: a) Order number b) VAT number with which made the order and delivery address

6.2 By decision of Azores PlaygroundAzores Playground reserves the right not to process orders, when it verifies any inconsistency in the personal data presented or observes misconduct by the buyer. Azores Playground reserves the right not to process any order or refund, in case of errors in the values and/or characteristics of the products, when these result from technical problems or errors alien to Azores Playground.

 

7. Return (Right of Resolution)

7.1. If you are not completely satisfied with the Azores Playground product purchased, you have a period of 30 (thirty) days from the order date to return it, provided that you have not used the product(s).To exercise this right, the User must communicate the intention and the reason by filling out the Exchange/Return Form available on the Azores Playground website, indicating the order data and your personal data. In response, Azores Playground will indicate the procedure for the return.

7.2 The customer who placed his first order and wishes to make a return (provided that the collection address is in Continental Portugal), will not have any additional cost with the same, since Azores Playground will assume this burden.

7.3 In case the collection address is in the Autonomous Regions or in another country other than Portugal, the customer must always deal directly with the return shipping to Azores Playground.

7.4 The User must, within 14 days from the date he or she has communicated his or her decision to return the product, return it to Azores Playground. If the collection is guaranteed by the brand, this time limit does not apply.

7.5 After receiving the return, Azores Playground will verify that the returned product(s) meet(s) the following requirements:a) The product(s) must be sent in a well-sealed package and must be well packed to ensure that there is no change in its condition during the logistics process.b) It must not show any signs of use or washing.

7.6. The User who sends product(s) to Azores Playground without fulfilling any of the requirements of the previous point, may not be entitled to a refund. The User will be contacted and will be offered a return, the postage being borne by the User.

7.7 The method of reimbursement depends on the payment method used for the respective order. In the case of credit card payments, these are credited to the respective account. In all other cases, the refund is made by bank transfer. There is also the possibility for the customer to choose to remain with credit in the Azores Playground store. In this case, the customer will be given a Gift Card with the amount in credit so that he can use it in the next purchase.

7.8 The refund is made within a maximum period of 14 days, counting from the moment the return is received by Azores Playground, provided that the brand is already in possession of the necessary data to proceed with the refund. The reception of the return will be communicated by email to the User.

7.9 The cost of postage will be refunded to the User if the article is returned due to a manufacturing defect or error in the order processing.

7.10 In the case of orders placed with promotions based on minimum order values, if the return of an item is less than this minimum value, the promotion will no longer apply and the amount to be returned will be calculated based on this premise.

 

8. Manufacturing defect

8.1. in case of “manufacturing defect”, i.e. when defects are detected in products which, in principle, do not fall under the scope of the respective warranty, the User must return the product, along with a copy of the invoice, within a maximum of 30 consecutive days from the invoice date, to the address provided by Azores Playground after receiving an email sent to azoresplayground.

8.2. In order to exchange the product, the User must ensure that the packaging is complete, containing all its components, in excellent condition.

8 .3. In the absence of any of the elements mentioned above, or if any of the components are not in excellent condition, there will be no exchange, and the product will be sent back to the User.

8 .4. In these situations, all logistical costs related to the return and exchange will be borne by Azores Playground, except when the User chooses a different and more onerous method of delivery than the accepted and less expensive method proposed by the Brand.

9. Deliveries

9.1. Azores Playground will always do its best to deliver your order as soon as possible. The number of days foreseen for the delivery of orders is calculated from the dispatch of the order and not from the date of registration. Delivery is made from Monday to Friday (except on local or national holidays), and it is not possible to make an appointment for delivery. In these cases, the customer should provide an address where he/she will be present between 9am and 7pm to ensure efficient delivery.If the delivery address provided by the customer is incorrect or incomplete, or the customer does not pick up his/her order on time, it may lead to its return to Azores Playground, or to the nearest post office of the address indicated by the customer, which may lead to additional costs to the customer.

10. Payments

The customer may choose to pay by ATM (only available in Portugal), MBWay (only available in Portugal), and Credit Card (Visa, MasterCard or Maestro).The order will not be considered accepted until it is effectively confirmed that payment has been received.

 

11. Intellectual Property

11.1 The Store is a registered website and the Service provided by the website itself is the responsibility of Azores Playgroud.

11.2 The User acknowledges that the Service contains confidential information and is protected by copyright and related rights, industrial property and other applicable legislation.

11 .3.  The User acknowledges that any content that appears in advertising, highlighting, promotion or mention of any sponsor or advertiser is protected by the laws relating to copyright and related rights, the laws relating to industrial property and other laws of property protection, so that any use of such content may only occur under the express authorization of their owners.

11.4 The User undertakes to fully respect the rights referred to in the previous paragraph, in particular by refraining from any acts that may violate the law or the aforementioned rights, such as the reproduction, commercialization, transmission or making available to the public of such content or any other unauthorized acts that have the same object.

 

12.Conditions of Security of the Service

12.1 The User undertakes to comply with all applicable legal provisions, namely, not to practice or encourage the practice of illegal acts or offensive to good manners, such as the indiscriminate sending of unsolicited communications in violation of the provisions of the legislation applicable to the processing of personal data and advertising communications through automatic calling devices, and must also comply with the rules of use of the Service, under penalty of Azores Playground suspending or deactivating the Service under the terms foreseen in point 13.

12.2 The User expressly acknowledges and accepts that the IP Network is a public electronic communications network which may be used by several users and, as such, is subject to computer overloads and therefore, Azores Playground does not guarantee the provision of the Service without interruptions, loss of information or delays.

12.3 Azores Playground also does not guarantee the provision of the Service in situations of unpredictable overload of the systems on which it is supported or force majeure (situations of extraordinary or unpredictable nature, external to Azores Playground and which cannot be controlled by the same).

12.4 In case of interruption of the provision of the Service due to unpredictable overload of the systems on which it is supported, Azores Playground undertakes to regularise its operation as soon as possible.

 

  1. Suspension and deactivation of the Service Shop

13.1 Regardless of any prior or subsequent communication, Azores Playground may, at any time, and according to its sole discretion, discontinue the provision of the Service and or part of the Service to one or all Users.

13.2 Azores Playground also reserves the right to immediately suspend or terminate the access to the Service, in the following cases: a) When the User does not comply with the conditions of use referred in point 4 and others referred in the General Terms and Conditions; b) When Azores Playground terminates the access to the Store, by prior notice of 15 (fifteen) days from the date of termination.

13.3 The suspension or termination of the Service by Azores Playground, under the terms of the previous paragraphs, does not imply the right of the User or third parties to any indemnity or other compensation, and Azores Playground may not be held responsible or in any way burdened, for any consequence resulting from the suspension, annulment, cancellation of the Service.

13.4 In the above described situations, Azores Playground will communicate to the User, previously in order that the User may, if he/she wishes, safeguard the content of his/her order viewing area within 3 (three) working days from the sending of the email or availability of the information in the main page of the Service.

 

14. Communications

14.1 Without prejudice to other forms of communication provided for in these General Conditions, notifications to the User relating to the Service, including any amendments to these General Conditions, may be made to the User’s email address, by SMS or by telephone.

14.2. The User agrees to receive any and all communication and/or notification related to their orders to the address, contact phone number and/or electronic mail address (“email”) indicated in the order process.

14.3 Azores Playground will only send additional information related with Campaigns, Launches, Promotions, if the User explicitly refers that he/she wants to receive this information, by subscribing the Newsletter through the appropriate forms.

14.4 At any time, you can request not to receive these communications and/or notifications through the email info@azoresplayground.com

 

15. Technical Configurations

15.1 Without prejudice of the following paragraph, Azores Playground may change the Service and/or the technical conditions of its provision, as well as the respective rules of use, and must inform the User of such changes with a minimum prior notice of 15 (fifteen) days.

15.2. The updated version of these General Conditions and its annexes is available on Azores Playground’s website.

 

  1. Changes

16.1 Whenever Azores Playground deems it necessary or convenient to optimize the browsing experience and/or improve connectivity conditions, it may remotely reformulate network configurations.

16.2. Without prejudice of what is set out in the following paragraphs, and given the innovative nature of the Service and the technological evolutions to which it may be subject to, Azores Playground may change its technical configurations whenever it deems convenient to adapt it to eventual technological developments.

16.3 Azores Playground does not guarantee, however, to the User, the realization of any upgrades or improvements in the Service.

16.4 Some upgrades or new features of the Service may only be available against payment by the User and/or subscription of Specific Conditions of Use.

 

17. Complaints

17.1. The User may submit any contractual conflicts to arbitration and mediation mechanisms which are or may come to be legally constituted, as well as complain to Azores Playground about acts and omissions which violate the legal provisions applicable to the acquisition of goods.

17.2. The complaint must be presented within a maximum period of 30 (thirty) days, counting from the knowledge of the facts by the User, being registered in the information systems of Azores Playground which shall decide on the complaint and notify the interested party within a maximum period of 30 (thirty) days from the date of its receipt.For any further question or doubt, please contact Azores Playground through info@azoresplayground.com

 

SHIPPING AND RETURNS

Shipping options may vary depending on the delivery address and availability of the items.
Portugal mainland – Shipping can vary between 3,45 and 5,80 euros, depending on the weight and number of packages. The estimated delivery time will vary between 3-5 working days, depending on the delivery address.
Islands – For the Azores and Madeira, shipping costs can vary between 3,45 and 5,80 euros, depending on the weight and number of packages. The estimated delivery time will vary between 3-5 working days, depending on the delivery address.
International destinations – To foreign countries, shipping costs will vary depending on the weight and number of packages, so please contact us to obtain a shipping quote.

 

RETURNS AND EXCHANGES

You can cancel an order if it is in pending status, which means that it has not yet been shipped.
If you have already received the order and it presents some problem or if for some reason you are not satisfied, you can return it, up to 30 days from the invoice date.
If you are a registered customer, you can manage your returns/size exchanges directly in your customer account. To do this, simply log in, go to Order History and enter the respective line of the order to return/exchange. You will find a button to process your “Return/Exchange” return and the process is very intuitive. You can select the option to pick up the return at your address and a courier will collect it for you or you can choose to send the order directly to our address.
If you have difficulties, or if you have placed your order as a non-registered customer, please contact us by e-mail at info@azoresplayground.com, indicating the order number and the reference, color and size of the item(s) to be returned or exchanged, so that we can follow up on the request.
We also inform you that you can only exchange for another size of the item you purchased. Due to system limitations, you will not be able to exchange for another item, so you should request a return and place a new order for the desired item.
After we receive your return at the warehouse, you will receive an e-mail with that notification and we will process your refund. In case of exchanges, we will ship the new size selected.
Refunds are made within 14 days from the date of return of the item(s) to the warehouse by bank transfer, please always indicate your IBAN and Swift code.
Azores Playground reserves the right to refuse returns where the communication has been made outside the established deadline, where the items are not in the same conditions in which they were purchased.
